The 2018 Farm Bill legalized several hemp-derived cannabinoids with the exception that they must be under 0.3% THC content on a dry weight basis. With this regulation, it was up to the states whether to permit or ban it.

2: Delta-8 THC is Completely New
Many believe Delta-8 is a recent discovery. In actuality, the first published study involving Delta-8 was in 1941 by Roger Adams and his colleagues at the University of Illinois.
3: Delta-8 isn’t Real THC

In a book titled “The Species Problem in Cannabis: Science & Semantics”, they discuss the difficulty in distinguishing the two plants from one another because there is no taxonomical difference between them. This is the very same book that established the 0.3% rule that we commonly see associated with hemp.
However, Delta-8 is indeed less potent than traditional Marijuana, as it can only be 0.3% percent THC while Marijuana can be between 15-30%.
4: Delta-8 is Drug-Test Friendly
This myth has been circulating since the legalization of Delta-8. However, this is far from the truth. The major component in marijuana is Delta-9, which is chemically similar to Delta-8. When they do the test, it will likely flag you as using cannabis.
